Terms and Conditions of Sale for Sauna

 

1. Definitions

a. "Seller" refers to Panorama Saunas, the provider of the sauna product. b. "Buyer" refers to the individual or entity purchasing the sauna product. c. "Product" refers to the sauna unit and any accompanying accessories or components.

 

2. Product Description

a. The Seller will provide a description of the sauna product, including specifications, dimensions, and features, either on the website or in printed materials.

b. The Buyer is responsible for reviewing the product description and ensuring it meets their requirements before making a purchase.

 

3. Pricing and Payment

a. The price of the sauna product will be as specified by the Seller at the time of purchase.

b. Payment must be made in full before the product will be delivered or made available for pickup.

c. The Seller reserves the right to change prices at any time without prior notice.

 

4. Orders and Delivery

a. Orders for sauna products may be placed through the Seller's website, over the phone, or in person.

b. The Seller will make reasonable efforts to deliver the product within the specified timeframe, but delivery times may vary depending on availability and other factors.

 c. The Buyer is responsible for providing accurate delivery information, including the delivery address and any special instructions.

d. Any delivery delays or issues will be communicated to the Buyer as soon as possible.

 

5. Installation and Assembly

a. The Buyer is responsible for the installation and assembly of the sauna product unless otherwise specified by the Seller.

b. The Seller may offer installation services for an additional fee, which will be outlined in a separate agreement.

 

6. Warranty

a. The sauna product is covered by a limited warranty, the terms of which will be provided to the Buyer at the time of purchase.

b. The warranty may vary depending on the specific product and components.

c. The Buyer must follow the manufacturer's instructions for use and maintenance to maintain warranty coverage.

 

7. Pre-Orders & Deposit Policy

 

Pre-Orders: For sauna units not part of our in-stock inventory, a non-refundable deposit is required. If an order containing these products is canceled, Panorama Saunas will retain the deposit to cover costs incurred, including but not limited to shipping, handling, storage, and resale efforts. Deposits on saunas that are part of our stocked inventory in New Zealand are refundable. A 20% deposit of the total order value is required to secure stock or future production. Deposits paid below this amount will not secure stock and may result in delivery delays based on availability. Full and final payment is required 48 hours before your sauna is dispatched from our warehouse. Orders not paid in full by this time will have the opportunity to reschedule their delivery date once.

 

8. Returns and Refunds

a. The Buyer may be eligible for a refund or exchange within a specified period, as outlined in the Seller's return policy.

 b. The sauna product must be returned in its original condition, including all accessories and packaging, to qualify for a refund or exchange.

c. Any shipping costs associated with returns or exchanges are the responsibility of the Buyer unless otherwise specified by the Seller.


Sauna’s can only be returned under our 60 Day Satisfaction Guarantee policy rules below if applicable.


Sauna’s cannot be returned if you simply change your mind (and 60 Day Satisfaction Guarantee is not applicable or expired).

 

60-Day Satisfaction Guarantee

 

To be eligible for the Seller's 60-day return policy, the following conditions must be met:

 

1. You must be the original purchaser of the sauna; this guarantee is non-transferable.

2. You are responsible for all removal and return shipping costs.

3. The sauna must be in like-new condition, as assessed by the Seller or their designated Agent.

4. The sauna must be free from any liens or security interests.

5. At least 30 days must have elapsed since the sauna was delivered.

6. The sauna must pass a complete inspection by our representative prior to any refund being issued.

7. Written notification of your intent to return the sauna is required.

 

Please note, our 60-Day Satisfaction Guarantee is exclusively for the purchase of brand-new saunas from our range and does not cover any other products.

 

9. Limitation of Liability

 

a. The Seller is not responsible for any direct, indirect, incidental, special, or consequential damages resulting from the sale or use of the sauna product.

 

b. The Buyer agrees to use the sauna product in line with the manufacturer's instructions and acknowledges any associated risks.

 

c. To the maximum extent allowed by New Zealand law, the Seller, its agents, or employees will not be liable for any indirect, special, incidental, or consequential damages, including but not limited to loss of use, data, business, or profits. The Seller, its agents, or employees will not be liable for injury to any person or for any damage claims, regardless of how they arise.

 

d. If the products are purchased for business purposes, as defined by the Consumer Guarantees Act 1993 ("the Act"), the Act's provisions do not apply to these purchases. Panorama Saunas assumes no responsibility or liability for any advice regarding local council regulations, including but not limited to building consents or resource consents. Any information provided is general and not meant to address your specific situation. All enquiries should be directed to and confirmed with the local council. The Seller will not be responsible for costs related to, but not limited to, building alterations, removal costs, delivery costs, or labor costs associated with replacing a sauna.

 

10. Privacy Policy

The Seller will not pass your personal information on to any other party without your permission. Please see our website for full privacy policy.

 

11. Damages or Loss in Transit

 

Products shipped from our warehouses are securely packed. In the unlikely event of damage or loss during transit, claims must be made as follows:

 

a. Before signing the pickup or delivery consignment from the freight carrier, the Buyer must check for any shortages or visible damage to the outer packaging. Any such issues must be noted on the freight carrier’s consignment note at the time of delivery.

 

b. You MUST inform both the Seller and the freight carrier of any damage (internal or external) within 24 hours of receiving your sauna.

 

c. The Seller does not accept liability for any indirect, special, incidental, or consequential damages resulting from the delivery and installation of the sauna at the destination. This includes but is not limited to, damage to structures, driveways, or any other third-party structures unrelated to the purchased goods.

 

12. Commercial Use

 

The Seller’s products are not intended for commercial use or to derive commercial benefits. You agree not to use, or permit a third party to use, the Seller’s products for any commercial purpose, including but not limited to advertising and promotional material, without the express written consent of the Seller.

 

13. Governing Law

a. These terms and conditions shall be governed by and construed in accordance with the laws of New Zealand

b. Any disputes arising out of or related to the sale of the sauna product shall be resolved through arbitration or mediation using the MBIE mediation services.

 

By purchasing the sauna product, the Buyer agrees to abide by these terms and conditions.
